Welcome to Seabear Design Studio (“we,” “our,” or “us”). By accessing or using our website and services, you agree to be bound by the following Terms and Conditions. If you do not agree to these terms, please do not use our website or services.
1. Services
Seabear Design Studio provides graphic design services, including but not limited to print and digital design. All services are subject to availability and are tailored based on the client’s requirements.
2. Intellectual Property
- Ownership of Designs: Upon final payment, ownership of the final approved design files will transfer to the client. However, Seabear Design Studio retains the right to use the work in portfolios, marketing materials, and as examples of previous work unless otherwise agreed.
- Third-Party Assets: Any third-party assets (e.g., fonts, stock images, or templates) used in the design remain the intellectual property of their original creators and may be subject to separate licensing terms.
3. Payment Terms (unless otherwise specified)
- Pricing: All services are billed at rates discussed and agreed upon before work begins. Our standard hourly rate starts at $95/hour unless otherwise specified.
- Deposits: A deposit of 25% is required before the commencement of any set-fee project.
- Final Payment: Final payment is due upon project completion and prior to the release of final files.
- Late Payments: Payments not received within 30 days will incur a late fee of 5%.
4. Revisions and Approvals
- Revision Policy: Projects include 2 rounds of revisions as part of the quoted fee. Additional revisions will be billed at our standard hourly rate.
- Approval: Clients are responsible for reviewing and approving all work prior to use or sending to print . Once approved, Seabear Design Studio is not responsible for errors (e.g., typos or incorrect information) in the final product.
5. Cancellation and Refunds
- Cancellation by Client: If a project is canceled by the client after work has begun, the client will be responsible for payment for all completed work up to the cancellation date.
- Refund Policy: Deposits are non-refundable, except in cases where Seabear Design Studio is unable to deliver the agreed-upon services.
6. Liability
- Limitation of Liability: Seabear Design Studio is not liable for any damages resulting from the use of our designs, including indirect or consequential damages.
- Client Responsibility: It is the client’s responsibility to ensure that all content provided for the project complies with applicable laws and regulations.
7. Confidentiality
We respect your privacy and treat all project-related information as confidential. We may share details with trusted third-party contractors if necessary for project completion.
8. Website Use
- Content Ownership: All content on our website, including text, graphics, and images, is owned by Seabear Design Studio or licensed from third-parties, and protected by copyright laws.
- Prohibited Use: You may not reproduce, distribute, or modify any content on our website without written consent.
9. Changes to Terms
Seabear Design Studio reserves the right to modify these Terms and Conditions at any time. Changes will be posted on this page with the updated effective date.
10. Governing Law
These Terms and Conditions are governed by the laws of British Columbia, Canada. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in British Columbia.
